என்ன சொல்கிறது 7-வது ஊதியக் குழு?

மத்திய அரசு ஊழியர்களின் சம்பளம் உயர்ந்துவிட்டதாகக் கருத முடியாது.

ஏழாவது ஊதியக் குழு தன் அறிக்கையை 19.11.2015-ல் மத்திய நிதியமைச்சரிடம் வழங்கி, பத்திரிகையாளர் சந்திப்பையும் நடத்தியது. அன்று முதல், ஊடகங்களும் சமூக வலைதளங்களும் மத்திய அரசு ஊழியர்களுக்கு அதிக அளவில் ஊதிய உயர்வு வழங்கப்படுவதைப் போல ஒரு தோற்றத்தை உருவாக்குகின்றன. ஆனால், உண்மை நிலை என்ன?

நாடு முழுவதும் கூட்டு நடவடிக்கைக் குழுவில் அங்கம் வகிக்கும் அனைத்து மத்திய அரசு ஊழியர்களின் அமைப்புகள் 50% அகவிலைப்படி உயர்ந்தவுடன், அடிப்படை ஊதியத்துடன் இணைக்க வேண்டும், 5 ஆண்டுகளுக்கு ஒரு முறை ஊதிய விகிதத்தை அரசுத் துறையில் இருப்பதுபோலவும் தனியார் துறையில் இருப்பதுபோலவும் மாற்ற வேண்டும் என்று கோரிக்கை வைத்தார்கள். அதற்காக 2012-ல் ஒரு நாள் அடையாள வேலை நிறுத்தமும் செய்தார்கள்.

ஐ.மு. அரசின் அலட்சியம்

அன்றைக்கு ஆட்சியில் இருந்த ஐக்கிய முற்போக்குக் கூட்டணி அரசு, 10 ஆண்டுகளுக்கு ஒரு முறைதான் ஊதிய விகிதத்தை மாற்ற முடியும் என்று கூறினாலும் ஊழியர்களின் கோரிக்கையை ஏற்று செப்டம்பர் 13-ல் ஊதியக் குழு அமைக்கப்படும் என்று நாடாளுமன்றத்தில் அறிவிப்பு செய்ததோடு விட்டுவிட்டது. மீண்டும் அனைத்து ஊழியர்களும் போராடியதன் விளைவாக பிப்ரவரி 2014-ல், ஓய்வுபெற்ற உச்ச நீதிமன்ற நீதிபதி ஏ.கே. மாத்தூர் தலைமையில், ஏழாவது ஊதியக் குழு அமைக்கப்பட்டு 18 மாதத்துக்குள் அறிக்கை அளிக்க வேண்டும் என்று ஆணை பிறப்பிக்கப்பட்டது.
இந்த ஊதியக் குழு வரம்பு, மத்திய அரசில் வேலை செய்கிற ஊழியர்கள், பாதுகாப்புத் துறை ஊழியர்கள், முப்படை வீரர்கள் அனைவரையும் உள்ளடக்கியது. ஏழாவது ஊதியக் குழுவின் கணக்குப்படியே ஏறக்குறைய 1 கோடி ஊழியர் மற்றும் ஓய்வூதியர்களுக்குப் பலன் கிடைக்கும். அரசாங்கமே மொத்தம் ரூ.1,02,000 கோடி செலவாகும் என்று தெரிவித்துள்ளது. குறைந்தபட்சம் 15%லிருந்து 23.55% வரை ஊதியம் உயரலாம் என்று ஊதியக் குழு அறிவித்துள்ளது.

7-வது ஊதியக் குழு பரிந்துரையை மத்திய அரசு ஏற்றுக்கொண்டுவிட்டால், மாநில அரசு ஊழியர்களுக்கும் அமல்படுத்தப்படலாம். சிலர், இந்த ஊதிய உயர்வு மத்திய, மாநில அரசுகளுக்கு ஒரு பொருளாதார சுனாமியாக மாறும் என்று எச்சரிக்கிறார்கள்.
இரண்டாவது ஊதியக் குழு பரிந்துரையால் ஊதியம் 14.2% உயர்ந்தது. 3-வது ஊதியக் குழுவால் 20.6%-ம், 4-வது ஊதியக் குழுவால் 27.6%-ம், 5-வது ஊதியக் குழுவால் 31.0%-ம் 6-வது ஊதியக் குழுவால் 54%-ம் உயர்ந்தது. 7-வது ஊதியக் குழுவின் பரிந்துரை 14.3%. 1957-ல் 2-வது ஊதியக் குழு அளித்த 14.2% உயர்வை 7-வது ஊதியக் குழுவும் பரிந்துரைத்துள்ளது. அதாவது, 4-வது, 5-வது, 6-வது ஊதியக் குழுக்கள் அளித்த உயர்வு இப்போது பறிக்கப்பட்டிருக்கிறது.

பாதிப்பை ஏற்படுத்தாது

முதலாவது ஊதியக் குழு தொடங்கி 5-வது ஊதியக் குழு வரை இந்தியாவின் தொழிலோ, பொருளாதாரமோ, இப்போது பேசப்படுவதுபோல் உயர்ந்திருக்கவில்லை. பொருளாதாரத்தைக் கட்டுக்குள் வைத்துக்கொள்ள வேண்டும் என்றால், அரசு ஊழியர்களின் சம்பளத்தை உயராமல் பார்த்துக்கொள்ள வேண்டும் என்ற சித்தாந்தம் பரவலாக்கப்பட்டுக்கொண்டிருக்கிறது. ஆனால், ஊதியக் குழுத் தலைவர் நீதிபதி. ஏ.கே. மாத்தூரே இது பொருளாதாரத்தில் அதிக பாதிப்பை ஏற்படுத்தாது என்பதைப் புள்ளிவிவரங்களுடன் விளக்கியிருக்கிறார்.

மொத்த உள்நாட்டு உற்பத்தியில் 6-வது ஊதியக் குழு நிதிச்சுமை பங்கு 0.77% தான். 7-வது ஊதியக் குழு பரிந்துரை அமலாகும்போது அது 0.56% ஆகக் குறையும் என்பதை அறிக்கை தெளிவுபடுத்தியுள்ளது. இந்த உயர்வுகூட 10 ஆண்டுகளுக்கு ஒருமுறைதான். பல்வேறு அரசுத் துறை, தனியார் துறைகளில் 4 அல்லது 5 ஆண்டுகளுக்கு ஒரு முறை ஊதிய உயர்வு வழங்கப்படுகிறது. எனவே, ஊதிய உயர்வு அதிகம் என்று சொல்வது நியாயமற்றது.
அத்துடன் ஊதியக் குழு தன் பரிந்துரையில் ஊழியர் நல விரோத நடவடிக்கை சிலவற்றைப் பரிந்துரைத்துள்ளது. 1957-ல் பிரதமர் நேரு தலைமையில் நடந்த 15-வது தொழிலாளர் மாநாட்டில் ஏற்றுக்கொண்ட கோரிக்கையின்படியே குறைந்தபட்ச ஊதியத்தைக் கணக்கிடுவதாகக் கூறும் ஊதியக் குழு, மாத ஊதியம் ரூ. 26,000 என்பதற்குப் பதிலாக ரூ.18,000-ஐ மாத ஊதியமாகப் பரிந்துரை செய்துள்ளது. 2015 ஜனவரியோடு ஒப்பிட்டுப் பார்த்தாலே, உணவுக்கும் மற்ற அடிப்படைத் தேவைகளுக்குமான அடிப்படைச் செலவு ரூ.11,341 ஆக இருக்கின்றபோது, வெறும் 9,218 ரூபாயை அடிப்படைச் செலவுக்காகக் காட்டப்பட்டிருக்கிறது. ஊழியருக்கு 524 ரூபாய் (3%) வாடகைப்படி போதுமென்று சொல்லப்பட்டிருக்கிறது. இந்த அடிப்படை ஊதியத்தை வரையறை செய்வதில் ஏற்பட்ட கோளாறுதான் கடைநிலை ஊழியர்கள் ஊதிய உயர்வு பெறுவதற்குப் பதிலாக இழப்புக்கு வழி செய்திருக்கிறது. உதாரணமாக, 1.1.2016-ல் ரூ.18,000 அடிப்படை ஊதியம் பெறும் ஊழியர் பெறும் ஊதிய உயர்வு (வீட்டு வாடகைப்படி இல்லாமல்) ரூ.2,250 மட்டுமே. ஆனால், புதிய ஓய்வூதிய திட்டத்துக்கு அதிகமாகப் பிடித்தம் செய்வது ரூ.110 மற்றும் குடும்பக் காப்பீட்டுக்குப் பிடிக்கும் பணம் ரூ.1,500. ஊதிய உயர்வு ரூ. 2,250, அவர் ஊதியத்திலிருந்து பிடிக்கப்படுவது ரூ. 2,600. எனவே, உண்மையில் அவர் ரூ.350 இழக்கிறார். அரசுக் குடியிருப்பில் வசித்தால் ஆயிரக்கணக்கில் இழப்பு ஏற்படும். பெருவாரியான கடைநிலை ஊழியர்கள் ரயில்வே, பாதுகாப்பு மற்றும் தபால் துறையைச் சேர்ந்தவர்கள். இவர்களுக்குத்தான் ஊதியக் குழு பெரும் அநீதி இழைத்திருக்கிறது. வெந்த புண்ணில் வேல் பாய்ச்சுவதுபோல் பெற்றுக்கொண்டிருக்கும் பல்வேறு சலுகைகளையும், உரிமைகளையும் பறிப்பதற்குப் பரிந்துரை செய்யப்பட்டுள்ளது.

பதவி உயர்வுக்கு ஆபத்து

உயர் நிலை அதிகாரிகளுக்கு இருப்பதுபோல் 5 பதவி உயர்வுகளைக் கேட்டிருந்தோம். 10, 20, 30 வருடங்களில் 3 பதவி உயர்வு கொடுப்பதற்குக்கூட ‘நல்ல உழைப்பு’ இருந்தால் மட்டும் போதாதாம். ‘மிகச் சிறந்த உழைப்பு’ தேவை என்று கூறியுள்ளது. இதை யார் முடிவெடுப்பது? பெண் ஊழியர்கள் எண்ணிக்கை 10% மட்டுமே. அவர்களுக்குக் குழந்தை பராமரிப்பு விடுப்பாக 6-வது ஊதியக் குழு 2 வருடம் கொடுத்தது. அதை இந்தக் குழு முதல் ஆண்டுக்கு முழுச் சம்பளம், 2-வது ஆண்டுக்கு 80% சம்பளம் மட்டுமே வழங்கப்பட வேண்டும் என்று பரிந்துரைத்துள்ளது. குடும்பக் கட்டுப்பாடு, மிகுதி நேர வேலைப்படி, சலவைப்படி உள்ளிட்ட 62 படிகள் எடுக்கப்பட பரிந்துரைக்கப்பட்டிருக்கிறது. சாதாரண ஊழியர்களுக்கு வழங்கப்பட்டு வந்த பண்டிகைக்காலக் கடன் உட்பட அனைத்து வட்டியில்லாத கடன்களும் நிறுத்தப்படவும் பரிந்துரைக்கப்பட்டுள்ளது. குறைந்தபட்ச ஊதிய விகிதத்துக்கும் அதிகபட்ச ஊதிய விகிதத்துக்கும் இடையிலான வேறுபாடு இந்தப் பரிந்துரைக்குப் பிறகு மேலும் அதிகரிக்கப்போகிறது. பதவி நிலைக்கு ஏற்ற ஊதிய விகிதங்களின் எண்ணிக்கையும் குறைவதற்குப் பதில் அதிகமாகப்போகிறது.

நன்மையும் உண்டு

இந்த ஊதியக் குழு ஒரு சில நல்ல பரிந்துரைகளையும் செய்துள்ளது. ஓய்வூதியர்களுக்கு அவர்கள் பணியில் இருந்து 1.1.2016-ல் ஓய்வுபெற்றால் என்ன ஓய்வூதியம் கிடைக்குமோ அந்த ஓய்வூதியம் கிடைப்பதற்குப் பரிந்துரை செய்துள்ளது. கருணைக்கொடை அதிகபட்ச உச்சவரம்பு ரூ.10 லட்சத்திலிருந்து ரூ.20 லட்சமாக உயர்த்தப்பட்டுள்ளது. இதன் பலன் உயர் அதிகாரிகளுக்கே செல்லும் என்றாலும், வரவேற்கப்பட வேண்டியதே. ஊழியர்களுக்கு மத்தியில் பிரிவை ஏற்படுத்திய ‘கிரேடு பே’, ‘பே பேண்ட்’ என்ற பிரிவினைகளை ஒழித்தது பாராட்ட வேண்டிய அம்சம். குழந்தைப் பராமரிப்பு விடுப்பு ஒற்றைப் பெற்றோரான (சிங்கிள் பேரண்ட்) ஊழியர்களுக்கும் விரிவுபடுத்தப்பட்டுள்ளது பாராட்டுக்குரியது. ஊதியத்தை மாற்றுவதற்குக் குறிப்பிட்ட காலம்வரை காத்திருக்காமல் தேவைக்கேற்றபோது மாற்ற வேண்டும் என்றும் பரிந்துரை செய்யப்பட்டுள்ளது.

5-வது ஊதியக் குழு தந்த படிப்பினையை அரசும் மறக்காது; ஊழியர்களும் மறக்க மாட்டார்கள். எனவே, மத்திய அரசு நிதர்சனத்தைப் புரிந்துகொண்டு பிரச்சினைகளைத் தீர்க்கும் என்று மத்திய அரசு ஊழியர்கள் காத்திருக்கிறார்கள்.

GAZETTE NOTIFICATION RELEASED BY THE GOVERNMENT ON 25.7.2016 ON THE ACCEPTANCE OF 7TH CPC RECOMMENDATIONS

ஊதியக்குழு வந்துவிட்டது   

     கொடுப்பதை   வாங்கிக்கொள் -- மத்தியஅரசு         


         குறைவானதை ஏற்க மாட்டோம் -- ஊழியர் சங்கங்கள் 


       

ஆரூடத்தை கடந்து ,அச்சத்தை போக்கி ,அமைதியாக ,ஊதியக்குழுவின் பரிந்துரையை அப்படியே உத்தரவாக வெளிவந்துவிட்டது . ஆம் ஏழாவது ஊதியக்குழுவின் உத்தரவு 25.07.2016 அன்று கெசட்டட் அறிவிப்பாக வந்தது .

1.ஊதியநிர்ணயம் --31.12.2015இல் அடிப்படைஉதியம் + தகுதியூதியம்   இதை 2.57 மடங்கினால் பெருக்கி அதற்கு அடுத்தநிலை PAY MATRIX படி நிர்ணயிக்கப்படும்.


2.புதியஊதியம் 01.01.2016 முதல் அமுல்படுத்தப்படும்.

 
3.நிலுவைத்தொகை 2016-2017 நிதியாண்டில்  வழங்கப்படும்.

 
4.ஆண்டு ஊதியஉயர்வு ஜனவரி 1/ஜூலை 1 இதில் ஒன்று ஊழியர்களின் பணிக்கு சேர்ந்தநாள் அல்லது MACP பதவி உயர்வு நாள் அடிப்படையில் வழங்கப்படும்.


5.பஞ்சபடியை தவிர இதர அலவன்சகள் அனைத்தும் உயர்த்தப்படாத ஊதியத்தில் என்ன வாங்கினோமோ அவை வழங்கப்படும்.


6.மெடிக்கல் ,LTC ,TOUR TA   போன்றவைகள் நீடிக்கும்.


7.CGEGISபிடித்தம்  பழைய முறையே தொடரும்.

  
8.புதிய பென்ஷன் திட்டத்தை முறைப்படுத்த (மாற்ற அல்ல )DOP & Training ,மற்றும் Finance செயலர்கள் அடங்கிய குழு அமைக்கப்படும்.


9.வழக்கம்போல் அனாமலி கமிட்டி அமைக்கப்படும் ( வழக்கம்போல் பல ஆண்டுகளுக்கு பிறகு அனாமலி கமிட்டி கொடுக்கும் பரிந்துரை அடுத்த அதாவது எட்டாவது ஊதியக்குழுவிற்கு அனுப்பப்படும் -- இது கடந்தகால (கசந்தகால )வரலாறு.

HIGH LIGHTS 

4.(1)  The Pay Matrix, in replacement of the Pay Bands and Grade Pays as in force immediately prior to the notification of this Resolution, shall be as specified in Annexure I in respect of civilian employees. 

 (2)  With regard to fixation of pay of the employee in the new Pay Matrix as on 1  day of January, 2016, the existing pay (Pay in Pay Band plus Grade Pay) in the pre-revised structure as on 31st  day of December, 2015 shall be multiplied by a factor of 2.57. The figure so arrived at is to be located in the Level corresponding to employee’s Pay Band and Grade Pay or Pay Scale in the new Pay Matrix. If a Cell identical with the figure so arrived at is available in the appropriate Level, that Cell shall be the revised pay; otherwise the next higher cell in that Level shall be the revised pay of the employee.   

 (3)  After fixation of pay in the appropriate Level as specified in sub-paragraph (2) above, the
subsequent increments in the Level shall be at the immediate next Cell in the Level.  


5. There shall be two dates for grant of increment namely, 1st  January and 1 st  July of every year, instead of existing date of 1 st  July; provided that an employee shall be entitled to only one annual increment on either one of these two dates depending on the date of appointment, promotion or grant of financial up-gradation. 

6. The Commission’s recommendations and Government’s decision thereon with regard to
revised pay structure for civilian employees of the Central Government and personnel of All India Services as specified at Annexure I and the consequent pay fixation therein as specified at
Annexure II shall be effective from the 1 st  day of January, 2016.  The arrears on this account shall be paid during the financial year 2016-2017.  

7. The recommendations on Allowances (except Dearness Allowance) will be referred to a
Committee comprising Finance Secretary and Secretary (Expenditure) as Chairman and Secretaries of Home Affairs, Defence, Health and Family Welfare, Personnel and Training, Posts and Chairman, Railway Board as Members. The Committee will submit its report within a period of four months. Till a final decision on Allowances is taken based on the recommendations of this Committee, all Allowances will continue to be paid at existing rates in existing pay structure, as if the pay had not been revised with effect from 1 st  day of January, 2016.

8. The recommendations of the Commission relating to interest bearing Advances as well as 
interest free Advances have been accepted with the exception that interest free Advances for Medical Treatment, Travelling Allowance for family of deceased, Travelling Allowance on tour or transfer and Leave Travel Concession shall be retained.  

9. The recommendations of the Commission for increase in rates of monthly contribution
towards Central Government Employees Group Insurance Scheme (CGEGIS) for various categories of employees has not been accepted. The existing rates of monthly contribution shall continue. Department of Expenditure and Department of Financial Services will work out a customised group insurance scheme for Central Government employees.  

10. The Government has accepted the recommendations of the Commission on upgrading of
posts except for those specified at Annexure III. The recommendations on upgradation specified at Annexure III will be separately examined by Department of Personnel and Training for taking a comprehensive view in the matter.  

11. The Government has not accepted the recommendations of the Commission on downgrading of posts and normal replacement will be provided in such cases.  

12. While revising the pay of Doctors in respect of whom Non Practicing Allowance is
admissible and Railway employees in respect of whom Running Allowance is admissible, it will be ensured that the actual raise in pay at the time of initial fixation is about 14.29 percent as
recommended by the Commission.  

13. The pay of officers posted on deputation under Central Staffing Scheme will be protected and the difference in the pay will be given to them in the form of Personal Pay to be made effective from the date of notification.  

14. Recommendations not relating to pay, pension and allowances and other administrative issues specific to Departments/Cadres/Posts will be examined by the Ministries/Departments concerned as per the Allocation of Business Rules or Transaction of Business RulesUntil a decision is taken by the Government on administrative issues pertaining to (i) Non Functional Upgradation (NFU) presently admissible to the Indian Police Service/Indian Forest Service and Organised Group  ‘A’ Services, (ii) two years’ edge to Indian Administrative Service officers vis-a-vis other All India Services/Organised Group  ‘A’ Services in empanelment under Central Staffing Scheme, (iii) grant of two additional increments at Senior Time Scale, Junior Administrative Grade and Selection Grade to Indian Police Service and Indian Forest Service at par with Indian Administrative Service and Indian Foreign Service (iv) a uniform retirement age for all ranks in Central Armed Police Forces, where the Commission could not arrive at a consensus, status quo shall be maintained.  

15. A Committee of Secretaries comprising Secretaries of Departments of Personnel and
Training, Financial Services and Pension and Pensioners’ Welfare will be set up to suggest measures for streamlining the implementation of the National Pension System (NPS).  

16. Anomalies Committees will be set up by Department of Personnel and Training to examine
individual, post-specific and cadre-specific anomalies arising out of implementation of the
recommendations of the Commission. 

17. Regarding pay and related issues concerning All India Services, appropriate action will be
taken by Department of Personnel and Training to give effect to the decisions on these matters as may be applicable to them. 

18. The Government of India wishes to place on record their appreciation of the work done by

the Commission.

Government of India, State Governments, Administrations of Union Territories and all other

I. Pay Fixation in revised Pay Structure:

உறங்கவிடாத மத்திய அரசு!


கடை, வணிக நிறுவன ஊழியர்களின் சேம நலனுக்கு சட்டம் இயற்ற மத்திய அரசு சிந்திக்கவில்லை

திரையரங்குகள், ஓட்டல்கள், வங்கிகள், அலுவலகங்கள் 24 மணி நேரமும் திறந்திருப்பதற்கும், இயங்குவதற்கும் புதிய சட்டம் கொண்டுவர மத்திய அரசு திட்டமிட்டுள்ளது. மத்திய அரசு திடீரென்று கடைகள் மற்றும் வணிக நிறுவனங்களின் பக்கம் தனது பார்வையைத் திருப்ப என்ன காரணம்? சுதந்திரமடைந்த இந்த 69 ஆண்டுகளில் கடை மற்றும் வணிக நிறுவனங்களுக்கென்று சட்டங்களே இல்லையா? யாருடைய விருப்பங்களை நிறைவேற்ற இப்புதிய நடவடிக்கை?

தொழிலாளர் சட்டங்கள்

சுதந்திரத்துக்கு முந்தைய காலனியரசு தொழிலாளர்களுக்கான எவ்வித உருப்படியான சட்டங்களையும் நிறைவேற்றவில்லை. தொழிலாளர் மற்றும் தொழிற்சங்கங்களின் ஆதரவைப் பெறுவதற்காக, சுதந்திரம் கிட்டியவுடன் தொழிலாளர்களைப் பாதுகாக்கும் சட்டங்களை இயற்றுவோம் என்று சுதந்திரப் போராட்டத்தில் ஈடுபட்ட காங்கிரஸ் கட்சி அறிவித்தது. இரண்டாம் உலகப்போர் முடிவுற்றவுடன் அமைக்கப்பட்ட இடைக்கால அரசு (1946) பம்பாய் மாகாணத் தொழிலாளர் உறவுச் சட்டத்தை இயற்றியது. இன்றைக்கும் அச்சட்டம் மகாராஷ்டிரா மற்றும் குஜராத் மாநிலங்களில் நடைமுறையில் உள்ளது. 1947-ல் தொழிற்தகராறு சட்டம் அகில இந்திய அளவில் கொண்டுவரப்பட்டது.

1948-ல்தான் தொழிற்சாலைகள் சட்டமியற்றப்பட்டது. அதன்கீழ் தொழிலாளர்களின் பாதுகாப்பு, உடல்நலன், சேமநலன் பற்றிய பிரிவுகள் புகுத்தப்பட்டன. ஒரு நாள் கட்டாய ஓய்வுடன் வாரத்தில் 48 மணி நேரத்துக்கு மிகைப்பட்டு ஊழியர்களை வேலை வாங்கக் கூடாது என்று கூறப்பட்டது. நிர்ணயித்த வேலை நேரத்துக்கு மேல் பணி செய்ய நேர்ந்தால் அதற்கு இரட்டிப்பு ஊதியமும், மாற்று விடுமுறையும் வழங்கச் சட்டம் வழிவகுத்தது. ஈட்டிய விடுப்பும், ஈட்டிய விடுப்புக்கான ஊதியமும் வழங்க நிர்ப்பந்தித்தது. பெண் ஊழியர்களை இரவு ஷிப்டில் அமர்த்துவதையும் தடை செய்தது.

இச்சட்டம் உற்பத்தியில் ஈடுபடும் தொழிற்சாலை களுக்கும், அதிலும் மின்சாரத்துடன் உற்பத்தி செய்யும் ஆலைகளில் பத்துத் தொழிலாளர்களுக்கு மேல் பணியாற்றினால் மட்டுமே பொருந்தக் கூடியதாகவிருந்தது. ஆயிரக்கணக்கான கடைகள், வணிக நிறுவனங்களில் பணிபுரியும் ஊழியர்களின் சேமநலனைக் கருதும் சட்டமியற்றுவதைப் பற்றி மத்திய அரசு சிந்திக்கவில்லை.

வழிகாட்டிய தமிழ்நாடு

சுதந்திரம் கிடைப்பதற்கு முன் வங்கிகளும், காப்பீட்டு நிறுவனங்களும் தனியார் வசமே இருந்தன. அவற்றில் பணிபுரிந்த ஊழியர்களின் நலனைப் பாதுகாக்க உருவாக்கப்பட்டதே ”வணிக நிறுவனங்கள் ஊழியர் சங்கம்”(கமர்ஷியல் எம்ப்ளாயீஸ் அசோசியேஷன்). அன்றைக்கு தலைசிறந்த பாரிஸ்டராக சென்னை உயர்நீதிமன்றத்தில் வழக்காடிய வி.ஜி.ராவ் அதன் தலைவர். அவர் சட்ட மேலவை உறுப்பினராக இருந்த காரணத்தினால் கடை மற்றும் வணிக நிறுவனங்களின் ஊழியர்களின் நலனைப் பாதுகாப்பதற்காக ஒரு சட்ட வடிவை தயார் செய்து, சட்டமன்றம் அச்சட்டத்தை நிறைவேற்ற உதவினார். இந்தியாவிலேயே முதன்முறை யாக உருவானதுதான் 1947-ம் வருடத்திய மதராஸ்(தமிழ்நாடு) கடை மற்றும் வணிக நிறுவனங்கள் சட்டம்.

இப்புதிய சட்டம், ஏறத்தாழ தொழிற்சாலைச் சட்டம் போலவே தினசரி வேலைநேரம், கடைத் திறப்பு மற்றும் மூடும் நேரங்கள், மிகுதி நேர வேலைக்கு இரட்டிப்புச் சம்பளம், கட்டாய வார விடுமுறை, பெண் ஊழியர்களுக்கு இரவு ஷிப்டு தடை போன்றவற்றை உறுதிசெய்தது. குழந்தைத் தொழிலாளர்கள் அமர்த்துவதைத் தடை செய்ததுடன் நிறுவனங்களில் தூய்மை, காற்றுவரத்து, வெளிச்சம் இவற்றை உறுதிப்படுத்துவதற்கான பிரிவுகளையும் உள்ளடக்கியிருந்தது. தொழிற்சாலைகளிலிருந்தது போல் கடைகளிலும், வர்த்தக நிறுவனங்களிலும் வலுவான தொழிற்சங்கங்கள் இருக்க மாட்டா என்ற புரிதலினால் வணிக நிறுவனங்களில் வேலைபார்க்கும் ஊழியர்களுக்குப் பணிப் பாதுகாப்பு வழங்கும் விதமாக எவ்வித முகாந்திரமுமின்றி தொழிலாளர்களைப் பணிநீக்கம் செய்வதைத் தடைசெய்தது. வேலைநீக்கம் செய்யப்பட்ட தொழிலாளர்கள் சங்க ஆதரவின்றியே பணி நீக்கத்தை எதிர்த்துத் தொழிலாளர் அலுவலர்களிடம் மேல்முறையீடுகள் செய்யவும் சட்டம் வழிவகுத்தது. தமிழ்நாட்டில் இயற்றப்பட்ட சட்டத்தை நகலெடுத்துப் பல மாநில அரசுகளும் அதேபோன்ற சட்டத்தை இயற்றின. தனியார் வங்கிகள் மற்றும் காப்பீட்டு நிறுவனங்களில் வலுவான தொழிற்சங்கங்கள் ஏற்படவும் இச்சட்டம் உதவியது.

கடை, வணிக நிறுவனங்களில் பணிபுரியும் ஊழியர் களின் பாதுகாப்புக்காக அனைத்து மாநிலங்களிலும் தனிச்சட்டங்கள் இருக்கையில் மத்திய அரசு ஏன் புதிய சட்டத்தை உருவாக்க வேண்டும்? மாநில அரசுகளின் அதிகாரங்களை பறிப்பதுடன் பன்னாட்டு நிறுவனங்க ளுக்குச் சிவப்பு கம்பளம் விரிக்கும் செயலிது.
பெங்களுரு மென்பொருள் நிறுவனமொன்றில் வேலை பார்த்த ஒரு பெண் இரவு ஷிப்ட் முடிந்தவுடன் வீடு செல்ல நிறுவனம் அமர்த்திய வாடகைக் காரில் பயணித்தபோது, வாகன ஓட்டுநர் அவரிடம் தவறாக நடக்க முற்பட்டார். இதுதொடர்பாக கர்நாடக அரசு அந்நிறுவனத்தின் மீது வழக்கு தொடர்ந்தது. இரவு ஷிப்டில் எப்படிப் பெண்களை நிறுவனம் அமர்த்தியது என்று குற்றம்சாட்டியது. அதற்கு ஆதரவாக, கர்நாடகா கடை மற்றும் வணிக நிறுவனங்களின் சட்டத்தின் பிரிவுகள் சுட்டிக்காட்டப்பட்டன. இதையடுத்து, அந்நிறுவனம் மேல்முறையீடு செய்துள்ளது. சமீபத்தில் சென்னையில் உள்ள தொழிலாளர் நீதிமன்றம் மென்பொருள் பொறியாளர்களும் ஊழியர்களே என்று தீர்ப்பளித்துள்ளது. இவ்வாறாக இச்சட்டம் இந்தியாவில் செயல்படும் மென்பொருள் நிறுவனங்களின் சுதந்திரமான சுரண்டலுக்குத் தடையாக உள்ளது. இதை மாற்ற மத்திய அரசு விழைகிறது.

பெரு நிறுவனங்களின் பேராசை

அம்பானி சகோதரர்களுக்கு ஒரு பக்கத்தில் பெட்ரோல் பொருட்களின் சந்தையில் பிடிப்பென்றால் மறு பக்கத்தில் சில்லறை விற்பனையிலுள்ள உப்பு, புளி, மிளகாய் வியாபாரத்திலும் லாபம் பார்க்க முயல்கின்றனர். மால்கள், திரைப்பட அரங்குகள், உணவு விடுதிகள், மதுபானக்கடைகள் நகர்ப்புறங்களில் பெருகிவருகின்றன. இவற்றைக் கட்டுப்படுத்தவும், அங்குள்ள ஊழியர்களின் நலன்களைப் பேணவும் தொழிலாளர் சட்டங்கள் பல உள்ளன. இவை மால்கள் நடத்தும் நிறுவனங்களைப் பாதிக்கின்றன.

எவ்வித சட்டப் பின்னணியோ நாடாளுமன்ற விவாதங் களோ இன்றி தாராளமயமாக்கலை நரசிம்மராவ் தொட்டு நரேந்திர மோடி வரை தடையின்றி அமல் படுத்திவருகின்றனர். அதற்கு ஆதரவளிக்க நீதித்துறையும் பின்தங்கவில்லை. 2005-ல் உச்ச நீதிமன்றம் அளித்த ஒரு தீர்ப்பில் இந்தியாவில் தாராளமயமாக்கல் வேரூன்றிவிட்டதாகச் சொல்லி, அதற்கு உதாரணமாகப் பெரு நகரங்களிலுள்ள விமான நிலையங்களில் மதுபானக்கடைகள் தொடங்கப்பட்டுள்ளதை சுட்டிக்காட்டி யுள்ளது. பெண்கள் மதுபானக்கடைகளில் மாலை நேரத்திற்குப் பிறகு வேலை செய்யக்கூடாது என்று டெல்லி அரசு போட்ட உத்தரவை உச்ச நீதிமன்றம் ரத்து செய்தது. சென்னை உயர் நீதிமன்றம் 2002-ல் இரவு ஷிப்டில் பெண்களுக்கான தடை விதித்த தொழிற்சாலை சட்டத்தின் 66-வது பிரிவை ரத்து செய்தது.

மென்பொருள் நிறுவனங்கள், கால்சென்டர்கள், மால்கள், திரையரங்குகள், உணவு விடுதிகள், மதுபானக் கடைகள் இவற்றை ஓரளவுக்கு ஒழுங்குபடுத்திவரும் மாநில அரசுகளின் சட்டங்களைத் தவிர்க்கும் விதமாகத்தான் மத்திய அரசு புதிய கடை, வணிக நிறுவனங்களை ஒழுங்குபடுத்தும் சட்டத்தை இயற்ற முற்பட்டுள்ளது. தடையின்றி, காலவரையற்ற வணிகம், இரவு ஷிப்டில் பெண்கள் இப்படிப் பல சலுகைகளையளித்து மோடி அரசு பன்னாட்டு நிறுவனங்களுக்குப் பச்சைக்கொடி காட்டியுள்ளது.

நூறாண்டுகளுக்கு முன் சிகாகோ நகரத்தில் போர்க்கொடி தூக்கி, எட்டு மணிநேர வேலைக்கு வழிவகுத்த சட்டத் தடைகளையெல்லாம் ஒரு நொடியில் தூக்கியெறிய மத்திய அரசு தயாராகிவிட்டது. மேலும் பெண்கள் இரவு ஷிப்டில் பணிபுரியத் தடைவிதிக்கும் சட்டங்கள் சர்வதேசத் தொழிலாளர் நிறுவனத்தின் (ஐ.எல்.ஓ) தீர்மானங்கள் அடிப்படையில் கொண்டுவரப்பட்டவையே. பகல் நேரத்திலேயே பொது இடங்களில் பெண்கள் மீதான வன்முறையைத் தடுக்க முடியாத கையாலாகாத அரசுகள், இரவுப் பணிபுரியும் பெண்களை எப்படிப் பாதுகாக்கும் என்பது புரியவில்லை.

இரவெல்லாம் கடைகளையும், திரையரங்குகளையும், உணவு விடுதிகளையும், மதுபானக் கடைகளையும் திறந்துவைக்க உதவும் மத்திய அரசின் சட்ட வடிவு, மக்களை உறங்கவிடாது.உறங்கும் உரிமையும் அரசியல் சட்டம் கூறும் அடிப்படை உரிமைகளில் ஒன்றென உச்ச நீதிமன்றம் ஒரு தீர்ப்பில் குறிப்பிட்டிருப்பது இனி வரும் காலங்களில் நகைமுரணுக்குள்ளாகும்.

Casual Workers - One day paid weekly off for working in offices having five day week - DoPT order

It has been decided that casual workers working in offices having a five day week may be allowed one day paid weekly off provided they have worked for a minimum of 40 hours during the said week. The relevant provisions of the Department of Personnel and Training OM No.49014/2/86-Estt (C) 7th June, 1988 are amended to this extent.
