Amending Rules for Safeguarding Women


Amendments to the Central Civil Services (Conduct) Rules, 1964 and Central Civil Services (Classification, Control and Appeal) Rules, 1965 have been carried out on 19.11.2014 to make working conditions more conducive for women. 

As per the new definition contained in the Explanation (1) under the amended Rule 3C of the Central Civil Services (Conduct) Rules, 1964, “sexual harassment" includes any one or more of the following acts or behaviour (whether directly or by implication) namely : -  


(i)      physical contact and advances; or


(ii)     a demand or request for sexual favours; or


(iii)    making sexually coloured remarks; or


(iv)    showing pornography; or


(v)     any other unwelcome physical, verbal, non verbal conduct of a sexual nature. 


The following circumstances, among others, if it occurs or is present in relation to or connected with any act or behaviour of sexual harassment may amount to sexual harassment : -


(i)      implied or explicit promise of preferential treatment in employment; or


(ii)     implied or explicit threat of detrimental treatment in employment; or


(iii)    implied or explicit threat about her present or future employment status; or


(iv)  interference with her work or creating an intimidating or offensive or hostile work environment for her; or


(v)     humiliating treatment likely to affect her health or safety.  


Further, as per Explanation (1)(c) under the Rule 3C of the Central Civil Services (Conduct) Rules, 1964,"workplace" includes,- 


(i)      any department, organisation, undertaking, establishment, enterprise, institution, office, branch or unit which is established, owned, controlled or wholly or substantially financed by funds provided directly or indirectly by the Central Government;


(ii)               hospitals or nursing homes;


(iii)   any sports institute, stadium, sports complex or competition or games venue, whether residential or not used for training, sports or other activities relating thereto;


(iv)    any place visited by the employee arising out of or during the course of employment including transportation provided by the employer for undertaking such journey;


(v)       a dwelling place or a house .

TN CM Panneerselvam urges PM Modi to use rural banks, post offices for cooking gas subsidy 

CHENNAI: Tamil Nadu Chief Minister O Pannerselvam today urged Prime Minister Narendra Modi to address certain deficiencies in the banking infrastructure while implementing the Modified Direct Benefit Transfer to LPG consumers scheme. 

In a letter to Modi, he pointed out that though the scheme required availability of adequate banking infrastructure across the state, people in remote and rural areas may find it difficult to access nationalised bank branches.(MDBTL) 

 "Therefore, in order to deepen penetration in villages, the Primary Agricultural Cooperative Societies and Post Offices can also be involved in delivering the subsidy, which would reduce the inconvenience. 

"In urban areas, urban co-operative banks can also be involved in the delivery of subsidy," he said and further urged for adequate banking facilities throughout the state. 

The CM said the total amount of subsidy should not be fixed and should be increased as and when the mark ..

NDA  AND UPA
TWO  SIDES  OF  SAME  COIN
               New Central Govt. under the leadership of our Hon’ble Prime Minister Shri. Narendra Modi has completed six months in office. As far as the common people and working class of this country is concerned, no positive action has been taken by the Govt. to mitigate their woes and grievances. Instead much negative steps are taken during this six months period.
                   Government has withdrawn the guidelines which controls the pricing of essential medicines through National Pharmaceutical Pricing Authority. As a result, the prices of essential medicines for treatment of cancer, blood pressure, colestorol, diabetics, heart-deceases etc will shoot up in the market. Prices of medicines for treatment of cancer itself which now costs Rs.8500 may go upto Rs.1,08,000/-. Pharmaceutical corporate companies are the beneficiaries.
                   Government has made its intention clear that the number of gas cylinders (LPG) per year will be reduced from existing 12 to 9 and also to link it to Aadhar and subsidies through direct cash transfer to Bank accounts. Earlier UPA Govt. has reduced the gas cylinders from 12 to 9 but subsequently it has been withdrawn the order due to widespread protests.
                   Govt. has deregularised the pricing of diesel. Earlier UPA Govt. has deregulated petrol prices and now the NDA Govt. has deregularised diesel price. Petroleum companies will now be free to decide the prices of petrol and diesel. Even-now the prices of petrol and diesel in India are 40% higher than the prices in the international market.
                   Govt. has decided to allow 100% Foreign Direct Investment (FDI) in Defence Production. Earlier this move of the UPA Govt. was opposed by NDA saying that it is against the national interest and security of the country. Defence production will now be completely privatised.
                   Govt. has decided to allow 100% FDI in Railways and also public-private-partnership (PPP). During his speech delivered in Australia Prime Minister has called upon the Industrialists of that country to country to invest in Indian Railways. Doors for privatisation of Railways is opened.
                   Govt. has decided to allow 49% FDI in Insurance sector. The bill for amending the Insurance Act for this purpose is pending in the Parliament and Govt. spokes person has hoped that the bill will be passed in this winter session of Parliament.
                   Govt. has decided to disinvest the share of all public sector nationalised banks upto 48%. Road map for privatisation of banking sector is drawn.
                   Govt. has made it clear that 100% FDI will be allowed in Pension Funds. The future of those who are under the New Pension Scheme will be uncertain due to Pension Fund Privatisation.
                   Govt has decided to sell the shares of profit making public sector undertakings such as ONGC, BHEL, coal India Ltd. etc to the tune of 25%.
                   Govt. has made it clear that Indian Post Office Act 1898 will be amended to facilitate grant of licences to multi-national courier services.  This will pave way for privatisation of postal sector.
                   While extending red-carpet welcome to the corporates and multinational companies, the Govt. has declared that all the labour laws which put hurdles before them will be amended. Govt. has already moved in Parliament Labour Law amendments to remove all the protections and rights now enjoyed by the working class including right to strike and right to form unions. 
                   Government has declared that all the loss-making public sector undertakings will be closed or privatised.  Air India, BSNL etc. are all in the hit-list.
                   Government has made it clear that its slogan is “minimum government and maximum governance”.  It has imposed a total ban on creation of new posts and for filling up of posts which are lying vacant for more than one year.
                   Regarding Central Government Employees, none of their legitimate demands are conceded by the Government.  DA merger, Interim Relief, Inclusion of Gramin Dak Sevaks (GDS) under 7th CPC, Date of effect of 7th CPC as 1-1-2014, Removal of 5% condition for compassionate appointment - everything stands rejected.
                   Regarding Postal employees none of the 39 demands raised by Postal JCA (NFPE & FNPO) is settled.  Three lakhs GDS are still not included in the 7th CPC and their future is uncertain, Revision of wages of Casual, Part-time, contingent employees with effect from 01-01-2006 is pending before the Government from 2008 onwards.  Cadre Restructuring, issues of Postmaster Cadre, Accountants, System Administrators, MMS etc. all pending or rejected. 
                   It is in the above background the Central Trade Unions, JCM National Council staff-side, Confederation of Central Govt. Employees & Workers and Postal JCA has decided to organise following agitational programmes.
1.      As a part of nation-wide agitation by all Central Trade Unions including BMS, INTUC, HMS, AITUC, CITU etc. has decided to organise Parliament March on 5th December, 2014 to protest against the anti-people, anti-labour policies of the NDA Government.  In the march they will declare future struggle programmes.
2.      All the organisations in the JCM National Council (Staff side) including Railways, Defence and Confederation has decided to organise a National Convention on 11th December, 2014 to decide future course of action for realisation of the legitimate demands of the Central Government employees.
3.      Postal JCA comprising NFPE, FNPO, AIPEU-GDS (NFPE) and NUGDS   has decided to organise a massive Parliament March of 20000 Postal& RMS employees including Gramin Dak Sevaks and Casual, Part-Time, Contingent employees on 4th December, 2014 demanding settlement of 39 point charter of demands.  PJCA has decided to go for indefinite strike.
                   NFPE calls upon the entirety of five lakhs Postal employees to participate in all the above programmes and make it a grand success.  Let us pledge that we shall continue our struggle till success.

வீண் பழியும் இலவம் பஞ்சும்


ஒரு ஊரில் வெட்டுபுலி என்ற ஒருவன் இருந்தான். அவன் ஒரு முறை தேவையில்லாமல் ஒரு கிராமவாசி மீது பழி சொல்லி பஞ்சாயத்தைக் கூட்டினான். பஞ்சாயத்திலும் கிராமவாசிக்குத் தண்டனை கிடைத்தது.

பின், வீட்டிற்கு வந்த வெட்டுபுலியின்யின் மனசாட்சி அவனை உறுத்தியது. கிராமவாசி மீது தான் பழி சொன்னதை எண்ணி வருந்தினான். எனவே, தன் பாவத்திற்கு ஏதாவது பிராயச்சித்தம் உண்டா என்று தேடினான்.

என்ன பிராயச்சித்தம் செய்வதென்று அவனுக்குப் புரியவில்லை. எனவே, அந்த ஊரிலிருந்த ஒரு துறவியிடம் சென்றான். “துறவியாரே! 

நான் இந்தக் கிராமத்தில் வசிக்கும் ஒருவர் மீது வீண் பழி சொல்லிவிட்டேன். அது என் மனத்தை உறுத்துகிறது. அந்தப் பழி சொன்ன பாவத்தில் இருந்து தப்பிக்க எனக்கு வழி கூறுங்கள்!” என்று கேட்டான்.

துறவி சிறிது யோசித்துவிட்டு, “இன்று இரவு மூன்று கிலோ இலவம் பஞ்சை எடுத்துப் போய் அந்த கிராமவாசியின் வீட்டுக்கு முன்பு பரப்பிப் போட்டுவிட்டு வந்து விடு. நாளை வந்து என்னைப் பார்,” என்று கூறினார்.

வெட்டுபுலியிடம் பஞ்சைக் கொண்டு சென்று கிராமவாசியின் வீட்டின் முன் பரப்பி விட்டான். பின் மறுநாள் சென்று துறவியைப் பார்த்தான். “துறவியாரே! என் பாவம் போய் இருக்குமா இந்நேரம்?” என்று கேட்டான்.

உடனே துறவி, “வெட்டுபுலி! நீ இப்போது அந்த கிராமவாசியின் வீட்டிற்குச் செல். அவன் வீட்டு முன் நீ நேற்றிரவு பரப்பி வைத்த பஞ்சை மீண்டும் பொறுக்கிக்கொண்டு வா,” என்று கூறினார்.

வெட்டுபுலி மிகுந்த ஆவலுடன் ஓடினான். ஆனால், ஒரு விரல் அளவு பஞ்சு கூட அங்கு இல்லை. எல்லாம் காற்றில் பறந்துபோய் விட்டிருந்தது. அதனைக் கண்ட வெட்டுபுலி திடுக்கிட்டான். மீண்டும் துறவியிடம் ஓடி வந்தான்.

“துறவியாரே! நேற்றிரவு நான் கிராமவாசி வீட்டின் முன்னால் போட்டுவிட்டு வந்த பஞ்சில் ஒரு துளிப் பஞ்சாவது இப்போது அங்கு இல்லை. என்ன செய்வது?” என்று கேட்டான்.

துறவி சிரித்துவிட்டு, “வெட்டுபுலி! நீ விரித்துப் போட்டுவிட்டு வந்த பஞ்சை இப்போது மீண்டும் எப்படி அள்ள முடியாதோ, அதே போல, நீ ஒருவர் மீது கூறிய பழியையும் அதனால் உனக்கு ஏற்பட்ட பாவத்தையும் மாற்ற முடியாது. 

திருப்பி வார முடியாத பஞ்சைப் போன்றது தான் உன் பழிச் சொற்களும். அவற்றையும் இனித் திருப்பி வார முடியாது. இறைவனிடும் உன் தவறுக்காக மன்னிப்பு கேள்,” 
என்று கூறினார்.

வெட்டுபுலிக்கு உண்மை புரிந்தது. அன்று முதல் மற்றவர்கள் மீது பழி சொல்லும் குணத்தையே விட்டுவிட்டான். பிறர் மீது வீண் பழி சுமத்துவதால் பலன் ஏதும் கிடைக்கப்போவதில்லை என்பதை உணர்ந்தான் வெட்டுபுலி.

Aadhar Based Bio-Metric Attendance System for all Central Govt Employees before 26.1.2015

 Dopt said in the order that the Aadhar Based Bio-Metric Attendance system will be installed in the offices located in Delhi/ New Delhi by 31st December 2014. In other places this may be installed by 26th January 2015.

Biometric attendance system is only an enabling platform. There is no change in the instructions relating to office hours, late attendance etc. which will continue to apply.

Sub: Introduction of AADHAR Enabled Bio-metric Attendance System

It has been decided to use an AADHAR Enabled Bio-metric Attendance System (AEBAS) in all offices of the Central Government, including attached/ sub-ordinate Offices, in India. The system will be installed in the offices located in Delhi/ New Delhi by 31st December 2014. In other places this may be installed by 26th January 2015

2. The equipment will be procured by the Ministries/ Departments as per specifications of DeitY on DGS&D Rate Contract from authorized vendors. The expenditure will be met by the Ministries/ Departments concerned under their O.E. The manual system of attendance may be phased out accordingly.

3. The Department of Electronics and Information Technology (DeitY) will provide the technical guidance for installing the system. The equipment already procured by DeitY have a built in AMC of three years. The Ministries/ departments may ensure that the equipment being procured by them have similar provision.

4. Biometric attendance system is only an enabling platform. There is no change in the instructions relating to office hours, late attendance etc. which will continue to apply. As per extant instructions, (contained in DoPT O.M. No: 28034/8/75- Estt-A dated 04-07-1975; No:28034/10/75-Estt-A dated 27-08-1975; No: 28034/3/82 —Estt-A dated 05-03-1982) half—a-day’s Casual Leave should be debited for each day of late attendance, but late attendance upto an hour, on not more than two occasions in a month, and for justifiable reasons may be condoned by the competent authority. In addition to debiting Casual Leave (or Earned Leave, when no CL is available). Disciplinary action may also be taken against government servants who are habitually late. Early leaving is also to be treated in the same manner as late coming.

5. These orders come into force with immediate effect.

6. All Ministries/ Departments are requested to bring this to the notice of all concerned.

Sub: Posting of Government employees who have differently abled dependents reg.
The undersigned is directed to refer to this Departments OM of even number dated 06.06.2014 (copy enclosed) exempting a Government employee, who is also a care giver of disabled child, from the routine exercise of transfer/rotational transfer subject to the administrative constraints. The word disabled includes (i) blindness or low vision (ii) hearing impairment (iii) locomotor disability or Cerebral Palsy (iv) leprosy cured (v) mental retardation (vi) mental illness and (vii) multiple disabilities.
2. The matter regarding the scope of disabled has been examined in consultation with the Department of Disability Affairs. Considering the fact that the autism spectrum disorder child requires constant caregiver support and it would be imperative for the Government employees to take care of their autism spectrum disorder child on continuous basis, it has been decided to include Autism in the term disabled, as defined in Para 3 of the above-mentioned O.M. dated 06.06.2014.
3. This issues with the approval of the MoS (PP).
4. All the Ministries/Departments, etc. are requested to bring these instructions to the notice of all concerned under their control.

NOTICE

Subject: Suggestion for promoting welfare of Pensioners’/Family Pensioners drawing pension / family pension from Central Government.

In accordance with Government of India “Allocation of Business” Rules, Department of Pension & Pensioners’ Welfare is responsible for policy and coordination including those relating to welfare of Central Government pensioners.

2. Government continues to take various measures for welfare of pensioners and for simplifying rules and procedures. With a view to involve various stakeholders viz pensioners, Pensioners Associations/ Ministries/ Departments/ Banks etc. in the process, it has been decided to invite suggestions in this regard from all stakeholders.

3. It is requested that suitable suggestions, specially for improving the functioning of the Department may be sent to Ms. Deepa Anand, Under Secretary, DOP &PW, Lok Nayak Bhawan, Khan Market, New Delhi-110003 ( e-mail: deepa.anand@nic.in/011-24644636 ) by 15.12.2014.
